END USER LICENSE AGREEMENT for WaveMaker

REDISTRIBUTION NOT PERMITTED

IMPORTANT -- READ CAREFULLY: This is a legal agreement between you (either an individual or an entity), the end user, and Sumanasa Technologies regarding use of the software product accompanying this Agreement (as defined below). By installing, copying, or otherwise using the software product, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, click on the "Decline" button and do not install, copy or use the software product.

EXCEPT AS SPECIFICALLY PROVIDED BELOW, THE TERMS OF THIS LICENSE AGREEMENT APPLY TO ALL VERSIONS OF THE SOFTWARE PRODUCT; INCLUDING VERSIONS DOWNLOADED OR ACQUIRED WITHOUT CHARGE ("SHAREWARE"), FULL VERSIONS FOR WHICH A FEE IS CHARGED, AND ANY LICENSE KEYS IF APPLICABLE.

1. GRANT OF LICENSE.
This license agreement grants you the following rights:

a) You may install, use, access, display, run, or otherwise interact with ("RUN") one copy of the software product, or any prior version for the same operating system, on a single computer, workstation, terminal, handheld PC, or other digital electronic device ("COMPUTER"). The primary user of the COMPUTER on which the software product is installed may make a second copy for his or her exclusive use on a portable computer.

b) You may also store or install a copy of the software product on a storage device, such as a network server, used only to RUN the software product on your other COMPUTERS over an internal network; however, you must acquire and dedicate a license for each separate COMPUTER on which the software product is RUN from the storage device. A license for the software product may not be shared or used concurrently on different COMPUTERS.

c) For multi-user licenses you agree not to install or use the software product simultaneously on more COMPUTERS than you have purchased a license for.

d) All rights not expressly granted are reserved by Sumanasa Technologies.

2. LICENSE RESTRICTIONS.
a) You may not: (i) permit other individuals to use the software product except under the terms listed above; (ii) modify, translate, reverse engineer, decompile, disassemble (except to the extent that this restriction is expressly prohibited by law) or create derivative works based upon the software product or documentation; (iii) copy the software product or documentation (except for back-up or archival purposes); (iv) rent, lease, transfer, or otherwise transfer rights to the software product or documentation; or (v) remove any proprietary notices or labels on the software product or documentation.

b) You may distribute only the Shareware version of this software product to third parties. You may not distribute any other version of this software product, or any applicable license keys, to any third party.

c) WaveMaker is distributed as shareware. It means that this software product is available to you for free evaluation. If you find this program useful and decide to keep it after the evaluation period, you agree to pay a registration fee. To register your software product, please visit

d) Once you obtain a Registration Key for the software product you must not publish or distribute the license key. You should take reasonable precautions to prevent the license key from being obtained by any third party.

3. DISCLAIMER OF WARRANTY
The software product is provided "AS IS," without a warranty of any kind. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED.

4. LIMITATION OF LIABILITY
SUMANASA TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED BY YOU OR ANY THIRD PARTY AS A RESULT OF USING OR DISTRIBUTING THIS SOFTWARE PRODUCT. IN NO EVENT WILL SUMANASA TECHNOLOGIES BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SOFTWARE PRODUCT, EVEN IF SUMANASA TECHNOLOGIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. SEVERABILITY
The user must assume the entire risk of using the program. IN NO EVENT WILL SUMANASA TECHNOLOGIES BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNT SUMANASA TECHNOLOGIES RECEIVED FROM YOU FOR A LICENSE TO THE SOFTWARE PRODUCT, EVEN IF SUMANASA TECHNOLOGIES SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

6. TERMINATION
The License will terminate automatically if you fail to comply with the limitations described herein. On termination, you must destroy all copies of the software product.
